Please read this Legal Disclaimer and Terms of Use ("Disclaimer") carefully before purchasing or using any products, mounts, accessories, or information from FlightPro USA ("FlightPro," "we," "us," "our"), accessible via flightprousa.com (the "Website").

By visiting our Website, purchasing our products, or utilizing our mounting solutions, you explicitly acknowledge, understand, and agree to be bound by the terms, conditions, and disclaimers outlined below. If you do not agree, you must immediately cease use of this Website and our products.

1. Aviation & Regulatory Compliance Disclaimer

All FlightPro products, including but not limited to tablet mounts, suction cup mounting systems, kneeboards, yoke mounts, and cabling accessories, are aftermarket, non-certified accessories.

• No FAA Certification: FlightPro products have not been certified, tested, or otherwise approved by the Federal Aviation Administration (FAA), Federal Communications Commission (FCC), or any other domestic or international aviation authority. They are not Supplemental Type Certificate (STC) parts and are not intended for permanent, structural, or certified installation in any aircraft.

• Portable Electronic Devices (PEDs): Any tablet, phone, GPS, receiver, antenna (including Starlink Mini or other satellite hardware), or device secured by a FlightPro mount is classified strictly as a Portable Electronic Device (PED). Its operation and mounting within the cockpit must comply with FAA Advisory Circular AC 91.21-1D ("Use of Portable Electronic Devices Aboard Aircraft") and any other applicable regulations.

2. Sole Responsibility of the Pilot-in-Command (PIC)

Under Federal Aviation Regulations (FAR) 14 CFR § 91.3, the Pilot-in-Command is the final authority and is directly responsible for the safe operation of the aircraft.

By purchasing or using FlightPro products, you agree that it is the sole and exclusive responsibility of the Pilot-in-Command to ensure that:

• No Control Interference: The placement of any FlightPro mount, safety tether, or attached device does not physically restrict, block, or interfere with any flight controls (yoke, stick, rudder pedals, trim wheels, throttles, mixture, or carb heat) or emergency equipment.

• Unobstructed Visibility & Egress: The mount and attached devices do not block the pilot’s clear field of view, critical flight instruments, engine gauges, warning lights, or emergency cockpit egress paths.

• No Electronic/Systems Interference: Any device mounted using our hardware does not cause electromagnetic, magnetic, or radio frequency interference with the aircraft's primary navigation, communication, or transponder systems.

• Secure Attachment: The pilot must physically inspect and confirm the secure attachment of the mount and device during the pre-flight checklist and monitor its security periodically during flight.

3. Assumption of Risk & Limitation of Liability

Aviation is an inherently high-risk activity. The use of temporary mounting hardware in high-vibration, high-altitude, and rapidly changing thermal environments carries risks of structural detachment, device drops, or pilot distraction.

• Assumption of Risk: You knowingly and voluntarily assume all risks, both known and unknown, associated with the use, mounting, and performance of FlightPro products in an aircraft cockpit or other vehicles (including boats, RVs, and off-road vehicles).

• Limitation of Liability: To the maximum extent permitted by applicable law, FlightPro, its founders, officers, employees, affiliates, partners, and suppliers shall not be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages of any kind. This includes, but is not limited to:

  • Damage to personal property, including tablets, smartphones, avionics, or other mounted hardware.

  • Damage to the aircraft interior, windshields, canopies, or structural panels.

  • Personal injury, bodily harm, or wrongful death resulting from the use, installation, adjustment, or failure of our mounts or products.

  • Fines, flight violations, or regulatory penalties incurred while using our products.

• Maximum Liability: In no event shall FlightPro’s total aggregate liability to you for all damages, losses, and causes of action exceed the actual purchase price paid by you to FlightPro for the specific product causing the alleged damage.

4. No Warranty ("As-Is" Product Sales)

Except as explicitly stated in our written return policy, all products and information provided on this Website are distributed on an "As-Is" and "As-Available" basis, without warranties of any kind, either express or implied.

To the fullest extent permissible pursuant to applicable law, FlightPro disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or freedom from defects. We do not warrant that our suction mounts will maintain suction under all environmental conditions (including extreme temperature swings, humidity, or high-G maneuvers).

5. Third-Party Product Use

FlightPro products are frequently designed to hold, mount, or integrate with third-party consumer electronics and hardware (e.g., Apple iPads, Starlink systems).

• FlightPro is not affiliated with, endorsed by, or partnered with Apple, Starlink (SpaceX), or any other third-party manufacturer unless explicitly stated.

• We make no representations or warranties regarding the safety, compatibility, or performance of third-party devices when used in conjunction with our products.

6. Indemnification

You agree to indemnify, defend, and hold harmless FlightPro USA, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

1. Your violation of this Disclaimer or our Terms of Service.

2. Your negligent, reckless, or improper use of FlightPro products inside an aircraft or other vehicle.

3. Your failure to comply with FAA, federal, state, or local aviation and transport regulations.

8. Governing Law and Jurisdiction

This Disclaimer, and any disputes arising out of your use of our Website or products, shall be governed by, construed, and enforced in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any legal action or proceeding relating to this Disclaimer must be brought exclusively in the state or federal courts located in Georgia.
